3. Account Registration and Security
3.1 Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an Account.
3.2 Account Security
You are responsible for:
- maintaining the confidentiality of your account credentials
- all activities that occur under your Account
- notifying us promptly of any unauthorized use
3.3 Suspension or Termination
We may suspend or terminate Accounts that violate these Terms, abuse the Service, or create legal, operational, or security risk.
4. Scope of the Service
4.1 What Tekton Provides
Tekton provides:
- MCP-assisted UI workflows, including discovery, validation, and integration tools
- design system runtimes, tokens, themes, and related packages
- account surfaces that may show usage, entitlements, shadow billing, or billing status
- legacy downloadable assets for customers who purchased them under prior plans
4.2 Delivery Method
The Service is delivered digitally through hosted account surfaces, MCP/API access, and downloadable packages. No physical goods are shipped.
4.3 Updates and Availability
- Active Plans receive access, updates, and support according to the pricing page or checkout terms shown at purchase.
- Legacy Assets continue to receive the update/support window stated at the time of the original purchase, unless a different migration policy is explicitly announced.
- During transition phases, we may show shadow billing or quota forecasts before those amounts become billable.
5. Pricing, Billing, and Payment
5.1 Pricing Model
Pricing, included Tool Units, renewal intervals, top-up availability, and any overage terms are shown on the pricing page and at checkout at the time of purchase.
5.2 Shadow Billing
We may display estimated or shadow usage before billing enforcement begins. Shadow usage is informational unless the pricing page, checkout, or an in-product billing notice explicitly states that billing enforcement is active.
5.3 Payment Processing
All payments are processed through Paddle (our Merchant of Record). By making a purchase, you also agree to Paddle's applicable terms.
5.4 Subscription Terms
- Recurring Plans renew automatically unless cancelled before renewal.
- You may cancel through the billing surface or by contacting us.
- Cancellation takes effect at the end of the current billing period unless otherwise required by law.
5.5 Currency and Taxes
Prices are shown in the currency displayed at checkout. Applicable taxes are calculated and collected by Paddle based on your location.
6. Access Rights and Restrictions
6.1 Permitted Use
Subject to these Terms and your purchased entitlements, we grant you a non-exclusive, non-transferable right to:
- use the Service for your own internal projects and client work
- use Outputs in your products and deliverables, subject to third-party and open-source license obligations
- access Legacy Assets you validly purchased under the prior business model
6.2 Restrictions
You may not:
- resell, redistribute, sublicense, or share Service access, Accounts, API keys, or raw downloadable assets except as explicitly permitted
- circumvent quota controls, usage metering, billing enforcement, or authentication systems
- use the Service to build a competing template or asset marketplace by redistributing our assets
- interfere with the Service, perform abusive automation, or create unreasonable load
- use the Service for unlawful purposes or to violate third-party rights
6.3 Legacy Asset Rights
If you purchased Legacy Assets under the prior template-license model, those asset-use rights continue under the terms that applied at the time of purchase, except where a migration policy gives you additional rights.
7. Intellectual Property
7.1 Our Ownership
The Service, MCP tools, prompts, themes, components, documentation, branding, and downloadable assets remain our property or the property of our licensors. Your purchase grants access or usage rights, not ownership.
7.2 Your Content and Outputs
You retain ownership of your original content. Subject to our underlying intellectual property and any third-party licenses, you may use Outputs generated for your Account in your own products and client deliverables.
8. Service Characteristics and Disclaimer of Warranties
Tekton includes MCP, LLM-assisted, and automated workflow features. These systems are probabilistic and may produce incomplete, incorrect, inconsistent, or non-production-ready results.
You are responsible for reviewing and validating Outputs before using them in production, legal, financial, security-sensitive, or customer-facing contexts.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE, OUTPUTS, AND ALL RELATED MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not guarantee that:
- the Service will be uninterrupted, secure, or error-free
- any Output will be accurate, complete, or suitable for your use case
- defects or errors will always be corrected
- the Service will be available at all times
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE, OUTPUTS, BILLING, OR YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO US DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
10. Copyright and IP Complaints
We respect the intellectual property rights of others. If you believe material on the Service infringes your rights, please contact us at [email protected] with enough detail for us to review the claim.
11. Third-Party Services
The Service integrates with third-party services including:
- Paddle: payment processing
- Supabase: authentication and database
- Vercel: hosting
We are not responsible for the availability or practices of those third-party services.
12. Termination
12.1 By You
You may stop using the Service at any time and may request Account deletion by contacting us.
12.2 By Us
We may terminate or suspend access if you violate these Terms, fail to pay amounts due, abuse the Service, or create security or legal risk.
12.3 Effect of Termination
Upon termination:
- your right to access the Service ends
- accrued payment obligations remain enforceable
- legacy asset rights that were already validly granted continue according to their applicable terms
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice by email, the website, or the product. Continued use of the Service after the effective date of the updated Terms constitutes acceptance.
14. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Korea, without regard to conflict of law principles. Unless applicable law requires otherwise, disputes shall be resolved by the competent courts of Korea.
